Determine who was at fault
Determining who was at fault is the best place to begin. This is crucial to determine whether financial compensation may be available. Does the police or incident report say that you were at fault? What is your wage loss?
How much money do you earn and how much time will you miss from work? Can you return to your employment at all? Your lost earnings claim generally depends on the amount of money you were making prior to the accident.
Does the at-fault party have the resources to pay?
Although it isn’t fair, the financial status of the at-fault party is a factor to be considered when determining your prospects for receiving the compensation. Who was really at fault? What areas or aspects of your claim have been overlooked? Is there insurance available? If so, what are the limits for your type of claim?
Who is your attorney?
Finally, who is your lawyer? Although most injury attorneys typically charge the same fee, not everyone can get you the same compensation. Unfortunately the lawyer you hire to represent your interests will in all likelihood make a big difference in how much money you recover for your claim. For example, if your attorney cannot fight for and establish liability, you will probably not recover anything. Generally you only get one chance, choose an attorney with a proven record of success and experience handling cases similar to your situation. Although every case is different; when discussing your situation with any prospective attorney, ask what other types of verdicts or settlements they’ve obtained for similar cases.
