If you are involved in an accident that caused you personal injury you are entitled to a personal injury claim. If the extent of your injury is not so serious and you are able to process the claims then you can handle personal injury claims on your own. You can do away with the services of lawyers and their expensive fees. All you need to do is to learn how to go about it, and have a lot of patience. But for cases where injuries are severe you might not be able to go thru the process on your own. You will definitely need a lawyer. But assuming that you are capable of going thru the process, here are the things you have to do: Inform the proper authorities of the incident. In the case of road accidents report to the police , in cases of slipping on a wet floor of a supermarket inform the manager, and if you tripped on a broken pavement or experienced work related accidents inform the company. Have a written report of the incident on the day it happened since you are able to recall every detail of the incident. Keep a list of the names, addresses and even contact numbers of all the people present during the incident for they are your possible witnesses. You have to be able to provide evidence that the incident really happened, so document everything. Use photographs, or even a video to record the event as it happened. Showing how a certain defective product has caused you injury in a video, for instance, could strengthen your personal injury claim. Always be able to provide information such as the exact time, place, and position of the cars when the incident happened. If you were admitted to a hospital because of the injury sustained, keep records of medical bills, receipts, medicines and doctor's fee and other medical expenses you might have incurred. If as a result of the injury you were not able to work, have a written document made of the loss of income from your employer. A soon as everything is ready write a letter to the person or insurance company of the other party who has caused you injury stating him or them that you are going to claim compensation for the damages done to you by his or their negligence. Copies of all your evidence should be included in the letter. Clearly state the extent of your injury with all the pain and suffering you had to bear and the amount of the compensation you are going to claim. The insurance company will review your demand letter and they will then make their initial offer for the settlement of the case. If the offer given is reasonable for you then you can accept it. If not negotiate for a settlement that is acceptable to you. If there is no settlement reached then you will have to decide whether to accept whatever offer they would give or file a lawsuit. At this point you will have to get a lawyer who will represent you in court for your personal injury claim.
